Privacy Policy
At The 360 Degrees Health & Wellness Company (“360”), we are committed to providing our customers with exceptional service. As providing this service involves the collection, use and disclosure of some personal information about our customers, protecting their personal information is one of our highest priorities.
We will inform our customers of why and how we collect, use and disclose their personal information, obtain their consent where required, and only handle their personal information in a manner that a reasonable person would consider appropriate in the circumstances.
This Privacy Policy, in compliance with BC’s Personal Information and Protection Act (“PIPA”) and any other applicable privacy legislation, outlines the principles and practices we will follow in protecting customer personal information. Our privacy commitment includes ensuring the accuracy, confidentiality, and security of our customers’ personal information and allowing our customers to request access to, and correction of, their personal information.
Scope of this Policy
This Privacy Policy governs the collection, use and/or disclosure of Personal Information from external sources during the course of 360’s business. It applies to 360 and its subsidiaries and affiliated companies, including but not limited to Spa Utopia, Absolute Spa, and Soluzione Health & Beauty Products.
This policy also applies to any service providers collecting, using or disclosing personal information on behalf of 360, but does not apply to any third-party websites linked from our websites, as such websites are governed by their own privacy policies.
360 may change or update this Privacy Policy at any time without notice and for any reason. Revised versions of this Privacy Policy will be made available on our websites (or on request made to any of our business locations) and will be effective from the date of release.
Definitions
Personal Information – means information about an identifiable individual, such as their name, date of birth, gender, home address, personal phone number, personal email address, Internet Protocol (IP) address, personal interests and shopping preferences. Personal information does not include business contact information.
Personal Health Information – Personal Health Information (“PHI”) is Personal Information that is related to a person’s health or the provision of health services to them. Examples are: medical histories, test and laboratory results, mental health conditions, insurance information and other Personal Information that we use to provide quality care and services and to meet our legal and professional requirements.
Business Contact Information – means information that would enable an individual to be contacted at a place of business and includes name, position name or title, business telephone number, business address, business email or business fax number. This is information that would normally be found on someone’s business card. Contact information is not covered by this policy or PIPA.
Privacy Officer – means the individual designated responsibility for ensuring that 360 complies with this policy and PIPA.
Privacy Principles
360 has adopted privacy principles consistent with the Canadian Standards Association’s “Model Code for the Protection of Personal Information”. The code contains ten (10) information principles that are generally described as follows:
Accountability – An organization is responsible for Personal Information under its control and shall designate an individual or individuals who are accountable for the organization’s compliance with these principles.
Identifying Purposes – The purposes for which personal information is collected shall be identified by the organization at or before the time the information is collected.
Consent – The knowledge and consent of the individual are required for the collection, use or disclosure of personal information, except when obtaining consent would be inappropriate.
Limiting Collection – The collection of personal information shall be limited to what is necessary for the purposes identified by the organization. Information shall only be collected by fair and lawful means.
Limiting Use, Disclosure and Retention – Personal Information shall not be used or disclosed for purposes other than those for which it was collected, except with the consent of the individual or as required by law. Personal Information shall be retained only as long as necessary for the fulfilment of those purposes.
Accuracy – Personal Information shall be as accurate, complete and up-to-date as is necessary for the purposes for which it is to be used.
Safeguards – Personal Information shall be protected by security safeguards appropriate to the sensitivity of the information.
Openness – An organization shall make readily available to individuals specific information about its policies and practices relating to the management of personal information.
Individual Access – Upon request, an individual shall be informed of the existence, use, and disclosure of their personal information and shall be given access to that information.
Challenging Compliance – An individual shall be able to address a challenge concerning compliance with the above principles to the organization’s Privacy Officer or other individual accountable for the organization’s compliance.
Collecting Personal Information
Unless the purposes for collecting personal information are obvious and the customer voluntarily provides his or her personal information for those purposes, we will communicate the purposes for which personal information is being collected, either orally or in writing, before or at the time of collection.
We will collect customer personal information that is necessary to fulfill the following purposes:
To respond to customer inquiries and concerns about 360’s business or the products it sells or offers; to verify identity; to identify customer needs and preferences; to open or manage a customer account; to deliver requested products and services; to provide health services; to enrol the customer in a program; to ensure a high standard of service; and to meet regulatory requirements.
Consent
We will obtain customer consent to collect, use or disclose personal information except where authorized by law. Consent may be oral, written, electronic, provided by an authorized representative, or implied.
Customers may withhold or withdraw consent subject to legal or contractual limitations.
Using and Disclosing Personal Information
We will only use or disclose customer personal information where necessary to fulfill the purposes identified at the time of collection.
Retaining Personal Information
Personal information will be retained only as long as necessary for legal or business purposes.
Ensuring Accuracy of Personal Information
Customers may request corrections to their personal information in writing.
Securing Personal Information
We are committed to ensuring the security of customer personal information using appropriate safeguards.
Providing Customers Access to Personal Information
Customers may request access to their personal information subject to legal exceptions.
